We may choose not to accept orders at our sole discretion, even after sending a confirmation. If we deny your order after payment, you will receive a refund to your original payment method.

The price charged will be the price in effect at the time the order is placed (and detailed in your confirmation if applicable). Posted prices do not include taxes or shipping/handling charges. SHIPPING POLICIES We will arrange for product shipment. Check individual product pages for delivery options. You pay all shipping/handling charges specified during ordering. Tracking information is provided upon shipment, but shipping/delivery dates are estimates and not guaranteed. We are not liable for shipment delays.

Provide an accurate shipping address. We are not responsible for delays or missed deliveries due to incorrect address information. If you notice an error after ordering, contact customerservice@kcsmokeshop.com immediately.

RETURNS AND REFUNDS Except for items marked final sale or non-returnable, we accept returns for a refund of the purchase price (less original shipping/handling) if returned within thirty (30) days of delivery with valid proof of purchase, provided products are in original, unused condition.

INDEMNIFICATION You agree to defend, indemnify, and hold harmless Dream KC Smoke Shop and its affiliates, directors, officers, employees, agents, etc. (the “Indemnified Parties”) from all claims, losses, damages, expenses (including attorneys' fees) arising from: (a) your access/use/misuse of the Site (kcsmokeshop.com); (b) your breach of these Terms; (c) your violation of laws/regulations. The Indemnified Parties may assume exclusive defense of any claim, and you agree to cooperate.

ARBITRATION AND CLASS WAIVER If a dispute arises, first contact us atcustomerservice@kcsmokeshop.com to attempt informal resolution. Claims not resolved informally proceed as below.

PLEASE READ CAREFULLY: THIS REQUIRES ARBITRATION AND LIMITS HOW YOU CAN SEEK RELIEF. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE ANY CLAIM ARISING FROM THESE TERMS OR SITE USE MUST BE RESOLVED THROUGH FINAL, BINDING, CONFIDENTIAL ARBITRATION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS. YOU ACKNOWLEDGE: (A) COURT RIGHTS MAY BE LIMITED/NON-EXISTENT; (B) CLAIMS MUST BE INDIVIDUAL, NOT AS PLAINTIFF/CLASS MEMBER; (C) ARBITRATOR CANNOT CONSOLIDATE CLAIMS OR PRESIDE OVER CLASS PROCEEDINGS.

NO JUDGE/JURY IN ARBITRATION; COURT REVIEW IS LIMITED. YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

• Arbitration Generally: Disputes not resolved informally within 90 days shall be settled by binding confidential arbitration via the American Arbitration Association (“AAA”) under Consumer Arbitration Rules. Judgment may be entered in any court with jurisdiction. Both parties agree to this. Governed by the Federal Arbitration Act (FAA).
• Exceptions: Does not apply to: (i) claims regarding infringement/validity/unauthorized use of our intellectual property (trademarks, copyrights, patents, trade secrets); (ii) action by Dream KC Smoke Shop for injunctive relief against your breach/threatened breach of these Terms. For these exceptions, parties consent to exclusive jurisdiction/venue of state/federal courts in and waive challenges.
• Commencing Arbitration: Must commence within one (1) year after claim arises. Claims after 1 year are barred. Submit written demand to AAA, copy to other party. Single AAA arbitrator selected per AAA rules (available at adr.org). Arbitrator decides arbitrability. 
• Fees: Governed by AAA Rules.
• Amendments: We may amend this provision; continued Site use affirms consent.
• Opt-Out: You may opt-out by written notice within 30 days of first accessing Site. . Include name, email, mailing address. If you opt-out, neither party can compel arbitration. If you don't opt-out in time, you must use arbitration.

INJUNCTIVE RELIEF Your breach/threatened breach of Terms or infringement of our rights causes irreparable harm. Dream KC Smoke Shop may seek injunctions or equitable relief. This doesn't prohibit other remedies (like monetary damages).

NOTICE AND TAKE-DOWN PROCEDURES (DMCA) If you believe your copyright/IP rights are infringed on the Site, provide our designated agent with:

• Signature (physical/electronic) of authorized person.
• Description of infringed work/IP.
• Location of infringing material on Site (URL preferred).
• Your contact info (address, phone, email).
• Statement of good faith belief use is unauthorized.
• Statement under penalty of perjury that info is accurate and you're the owner or authorized agent.

NO WAIVER Failure/delay by Dream KC Smoke Shop to enforce any provision doesn't waive the right to enforce it later or waive any other provision. Waivers must be written and signed by Dream KC Smoke Shop.

SEVERABILITY If any provision is found invalid/unenforceable, remaining provisions stay in effect. Invalid provision modified/severed to extent necessary to be enforceable.

ENTIRE AGREEMENT AND MODIFICATIONS These Terms, with the Privacy Policy, are the entire agreement between you and Dream KC Smoke Shop regarding Site use, superseding prior agreements/communications. Dream KC Smoke Shop reserves the right to modify Terms or the Site anytime. Check periodically for changes. Continued Site use after changes constitutes acceptance. You may not amend these Terms without written consent from Dream KC Smoke Shop.

FEEDBACK AND SUBMISSIONS Feedback (suggestions, ideas, comments) provided grants Dream KC Smoke Shop a non-exclusive, royalty-free, transferable license to use, reproduce, publish, distribute, etc., the feedback. You warrant feedback doesn't infringe third-party rights and you have rights to share it.
